Disclosure of Personal Information

Except as described in this statement, SmarterTools will not disclose personally identifying information about our customers to third parties without consent. We may share information regarding license verification, validation, and upgrade services to registered partners of SmarterTools. From time to time, SmarterTools, our authorized partners or contracted third parties may contact customers to gauge satisfaction with our products and/or services or to gather statements about SmarterTools or our products and services for marketing and promotional purposes (i.e. white papers, case studies, testimonials etc.) on the SmarterTools website or other public-facing websites. Such statements will not be used without the customer's consent. Finally, we may access or disclose information about you when it is required by law, such as pursuant to a subpoena or other judicial order, to enforce our agreements of policies governing your use of SmarterTools products and services, and/or to protect our intellectual property rights.

Security of Personal Information

SmarterTools is committed to protecting the security of your personal information. We employ industry-standard security measures to protect the loss, misuse, and alteration of the information we collect. For example, we store the personal information you provide on computer systems with limited access, which are located in controlled facilities. When we transmit highly confidential information (such as a credit card number) over the Internet we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. While on a secure page, site visitors will notice a security icon on the bottom of the visitor’s browser.

Changes to Our Privacy Policy

SmarterTools’ privacy policy may change from time to time. When we post changes to this privacy policy, we will revise the “last updated” date on this page.

Upon request, we may provide site visitors with access to all information (including proprietary information) that we maintain about them. Please contact our sales department to request and/or correct this information.

Collected Information

We may collect information about your interaction with SmarterTools sites and services. For example, we may use website analytics tools on our site to retrieve information, including the site you came from, the search engine(s) and the keywords you used to find our site, the pages you view within our site, your browser add-ons, and your browser's width and height, etc. We may also use cookies to collect information about the pages you view, the links you click and other actions you take on our site. Additionally, we collect certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times, and referring website addresses.

SmarterTools also collects and retains information you submit to us, including the email address of individuals that post messages to our community forums or communicate with us via email. It is up to you whether to submit information to us and how much information to provide. If you choose to become a SmarterTools customer or partner, we may ask for other personally identifiable information, and/or information used to monitor performance and protect our intellectual property rights. This additional collected information is defined in the software End User License Agreement (EULA), Partner Agreement, Terms of Service Agreement, or other related documentation.

If individuals submit resumes or employment applications online, we may ask for specific contact information, such as name, address, phone number, email address, and employment history. This information is collected and used to assess the individual’s qualifications for an open position within the company.

Use of Collected Information

SmarterTools collects and uses your information to operate and improve our site and services. These uses may include providing you with more effective customer service; making the site easier to use by eliminating the need to repeatedly enter the same information; performing research and analysis aimed at improving our products, services, and technologies; helping to diagnose technical problems; and other business functions.

We may also use your personal information to communicate with you. We may send certain mandatory service communications such as welcome letters, billing reminders, information on technical service issues, and security announcements. We may occasionally send emails to our customers regarding new features and upgrades to our products. Customers wishing to opt out of such emails can modify their subscriptions by logging into their customer account. Customers are responsible for maintaining the confidentiality and security of their user registration and passwords.

We do not send email to non-customers, except in cases where those email addresses are used as points-of-contact when a product or service is ordered, trial licenses are issued, technical support is required, or information is requested.
